Terms of use
These terms cover the free Keelwake account, the web app and syncing between your devices. In short: your data is yours, the service is free and honest — and at sea you decide, not the app.
Please note: this English page is a courtesy translation. The binding version is the German Nutzungsbedingungen.
1. Scope & provider
The provider of the Keelwake account, the web app at keelwake.de/app and the device sync is Miaris Engineering Systems, Niko Miaris, Helene-und-Maria-Schieß-Straße 8, 78467 Konstanz, Germany (“we”). For the purchase of the Keelwake app and in-app purchases through the Apple App Store, Apple's contract and licence terms apply in addition; these terms of use govern the account service.
2. The service
The Keelwake account is free. It gives you access to your Keelwake content in the browser and syncs it between devices. The native app works entirely without an account. We keep developing the service; features and presentation may change. There is no entitlement to uninterrupted availability — we operate the service with the care of a diligent provider, but without a guaranteed uptime figure.
3. Account & registration
- To register you need a valid email address and a password. Keep your password secret; actions taken through your account are attributed to you until you report misuse to us.
- Use requires that you are at least 16 years old, or that your legal guardians agree.
- You can delete your account yourself at any time (app: Settings → Account, web: Settings). This irreversibly deletes all account content — details in the privacy policy.
4. Your content
Everything you enter in Keelwake (logbook, voyages, crew, photos, notes) remains your content. You grant us only the technical right to store it, back it up and transfer it between your devices — for nothing else. If you enter other people's data (for example crew members), it is your responsibility that you are allowed to do so.
5. Navigation & safety at sea
Keelwake is a planning and documentation tool — not a means of navigation in the sense of maritime shipping. The nautical chart, the seamark display, weather data and distance and course calculations serve for orientation and preparation. They do not replace official nautical charts, nautical publications or your own seamanlike diligence. Responsibility for navigational decisions, for the safety of vessel and crew and for compliance with equipment requirements rests solely with the person in command. Chart data, seamarks (OpenSeaMap) and weather data (MET Norway) come from third parties and may be incomplete, out of date or incorrect.
6. Data backup
We back up the server data daily (encrypted, on a rolling 7-day cycle). Independently of that we recommend making your own exports regularly (app: Settings → Data backup, web: Settings → Export) — especially before major changes.
7. Prohibited use
The following are not permitted: attacks on the service (for example circumventing access controls, excessive automated requests, injecting malicious code), creating accounts with other people's data, and unlawful content. In the event of violations we may suspend the account and — after an unsuccessful warning, or immediately in serious cases — terminate and delete it.
8. Liability
We are liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health. In cases of ordinary negligence we are liable only for the breach of material contractual obligations (obligations whose fulfilment makes performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected. Section 5 remains unaffected: we accept no responsibility for nautical decisions based on the data displayed.
9. Term, termination & changes
The account contract runs for an indefinite period; you can end it at any time by deleting your account, and we can end it with 14 days' notice by email (the right to suspend under section 7 remains unaffected). If we discontinue the service, we will give notice with reasonable lead time so that you can export your data. We will announce changes to these terms at least 4 weeks in advance by email; if you do not object before they take effect, they are deemed accepted — we will point this out expressly in the announcement. If you object, the account contract ends when the change takes effect.
10. Final provisions
German law applies; mandatory consumer protection provisions of your habitual residence remain unaffected. Should any provision be invalid, the remainder stays in force. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
